A South African visa or permit application outcome may be positive (where the visa or permit is issued) or it may be negative.
Negative outcomes are required to be communicated in formal Notices which must also set out the reasons for the adverse decision. The timeframes for appealing, and the nature and presentation of the appeal or review application are technical issues which must be addressed appropriately.
Each matter is different because each applicant’s individual circumstances vary greatly, and coupled with bureaucratic inconsistencies, an approach to an adverse decision can be arduous and complex, often entailing a detailed explication of law.
The administrative compliance of the original application, submission location, type of application, validity of an existing status, accessibility to original documentation and timeframe expectations are just some of the factors that may influence an approach to addressing a negative decision and its findings by way of appeal or review.
